Terms and Conditions

Effective date: 02 October 2026

1. About us

Firpark Dairy Services is the trading name of Firpark Dairy Services Unlimited Company.

Business address: Firpark, Borrisokane, Co. Tipperary, E45 EY94, Ireland.
Email: info@firparkds.ie
Telephone: 085 873 7472

These terms apply to purchases through firparkds.ie. Installation, servicing and other individually quoted work may also have written terms supplied before you agree to the work.

Nothing in these terms excludes or limits rights that cannot lawfully be excluded or limited.

2. Consumer and business purchases

We supply both consumers and business customers.

You are a consumer where you are an individual buying wholly or mainly for purposes outside your trade, business, craft or profession. Purchases mainly for operating a farm or another business are generally business purchases.

Certain rights described below, including statutory online cancellation rights, apply to consumers. Business customers retain their rights under applicable law and any agreed contract.

3. Products and compatibility

Please check the product description, dimensions, part number and available options before ordering. Contact us if you need help identifying a part.

Photographs may show packaging or minor cosmetic details that differ from the item supplied. This does not permit us to supply goods that fail to match their agreed description or specifications.

Products must be installed and used in accordance with the manufacturer’s instructions. Electrical or specialist equipment should be installed by a suitably qualified person where required.

4. Prices and payment

Website prices are shown in euro and include VAT at the applicable rate. Applicable delivery charges and the order total are displayed before payment.

Payment is required before dispatch unless we have agreed credit or other payment arrangements in writing.

If we discover a pricing or stock error, we will contact you promptly. We will not charge a higher price or supply a substitute without your agreement. If we cannot fulfil your order, we will explain the position and refund any payment due.

5. Orders

Please provide an accurate delivery address, email address and telephone number.

An automated order acknowledgement confirms that we have received your order. Acceptance takes place when we send a dispatch confirmation or otherwise expressly confirm acceptance.

If we cannot accept an order because of stock availability, delivery restrictions or a payment problem, we will contact you and refund any payment taken for the unaccepted order.

Once an order has been accepted, these terms do not give us an unrestricted right to cancel it.

6. Delivery

Orders are normally dispatched within 1–3 working days after payment. Standard delivery within Ireland normally takes a further 3–5 working days after dispatch, unless a different timescale is stated or agreed.

These are estimates, not guaranteed delivery dates. We will contact you if we become aware of a significant delay.

Delivery charges, including any charges for bulky items, will be shown or agreed before you commit to the purchase.

For consumer orders, unless another delivery period has been agreed, we will deliver without undue delay and within 30 days of the contract. If delivery does not take place as agreed, your statutory rights to require delivery or cancel remain unaffected.

For consumer deliveries arranged by us, responsibility for loss or damage remains with us until you, or someone you nominate other than the carrier, takes physical possession of the goods.

Please contact us if an order is missing or arrives damaged. We will investigate with the delivery provider.

7. Consumer cancellation: changing your mind

For most goods bought online, consumers may cancel without giving a reason.

Tell us you wish to cancel within 14 days after you receive the goods. For a single order delivered in separate parts, the cancellation period normally runs from receipt of the last item.

You can cancel by emailing info@firparkds.ie, writing to our business address, or making another clear statement of your decision. Include your name and order details so we can identify the purchase. The cancellation form below is optional.

Send the goods back within 14 days after telling us you are cancelling.

Returns address: Firpark, Borrisokane, Co.Tipperary, E45 EY94.

You are responsible for the direct return costs where we informed you of this before purchase. For goods that cannot normally be returned by post, the applicable return cost or a reasonable estimate will be provided before purchase.

You may inspect goods as you would reasonably do in a shop. We may deduct a loss in value caused by handling beyond what is necessary to establish their nature, characteristics and functioning, where legally permitted.

Please package returns securely and include accessories. Original packaging is helpful, but its absence does not automatically remove your cancellation rights.

Cancellation refunds

For cancellation of an entire eligible order, we will refund the goods and the cost of our least expensive standard outbound delivery option. Additional charges for a more expensive delivery method you selected are not refundable.

Refunds will be made without undue delay and within 14 days after we are informed of your cancellation. Unless we have offered to collect the goods, we may withhold the refund until we receive them back or receive evidence that they have been sent back, whichever happens first.

We will use the original payment method unless you expressly agree otherwise, without charging a refund fee.

Exceptions

The statutory cancellation right has exceptions, including goods made to your specifications or clearly personalised, goods liable to deteriorate or expire rapidly, and sealed goods unsuitable for return for health or hygiene reasons once unsealed.

An exception applies only where its legal conditions are met. A product being electrical, discounted or ordered specially from a supplier does not, by itself, remove cancellation rights.

These exceptions do not remove rights relating to faulty or incorrectly supplied goods.

8. Business change-of-mind returns

For business purchases, we offer returns of unused standard-stock items within 14 days of delivery, in their original packaging and resaleable condition.

Please contact us with your order number before sending goods back so we can provide return instructions.

For these voluntary business returns, the customer pays return carriage and original delivery charges are not refunded.

Any different return arrangements for bespoke or individually quoted orders must be agreed in writing before purchase.

This section does not govern claims for faulty, damaged or incorrectly supplied goods.

9. Faulty, damaged or incorrect goods

Contact info@firparkds.ie with your order details and a description of the problem. Photographs may help us assess the issue, and we may arrange an inspection.

Please report visible delivery damage promptly, but a failure to report it within 24 hours does not automatically remove your statutory rights.

Stop using equipment if it appears unsafe. Using or testing an item does not, by itself, mean you have accepted a fault or waived your rights.

Consumers are entitled to goods that conform to the contract. Depending on the circumstances, remedies include repair, replacement, a price reduction or a refund. A fault arising within the first 30 days after delivery may entitle a consumer to terminate the purchase and receive a refund.

We will meet the necessary return or collection costs where required for a valid faulty-goods claim. Faulty-goods refunds will be made within the applicable legal deadline.

For business purchases, we will assess the claim under the contract and applicable law.

Any manufacturer’s warranty is additional to, and does not replace, statutory rights.

10. Installation and servicing

The scope, price, payment arrangements and expected timing of installation or servicing work will be agreed separately before work begins.

Additional work or charges require your agreement.

Where a consumer books a service online, by telephone or away from our premises, we will provide the applicable cancellation information before the contract is agreed. If you request work to start during a cancellation period, we will obtain any consent and acknowledgement required by law.

11. Liability

Each party remains responsible for losses for which it is legally liable.

Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

Consumer statutory rights are not limited by these terms. Any additional business-to-business liability arrangements must be separately agreed in writing and comply with applicable law.

12. Privacy

Our Privacy Policy explains how personal information is handled.

Purchasing from us does not, by itself, mean that you consent to marketing emails.

13. Website content

Website content belongs to Firpark Dairy Services or its respective owners and licensors. Manufacturer names and trademarks remain the property of their owners.

You may use product information for personal reference and purchasing decisions. Other copying or commercial reuse requires permission unless permitted by law.

14. Complaints and governing law

Please send complaints to info@firparkds.ie or write to our business address, including your order number and the outcome you are seeking.

These terms are governed by Irish law. This does not deprive consumers of mandatory protections or rights to bring proceedings in a court available to them under applicable law.

15. Changes to these terms

We may update these terms for future purchases. The version in effect when your contract was made will continue to apply to that purchase unless a change is required by law or agreed with you.

16. 24-Hour Damage Limit

Please inspect your order as soon as it is delivered. Any damage or issues with the goods should be reported to us within 24 hours of delivery so that we can review and assist with the matter promptly.

17. Electrical Goods

Electrical products should only be installed, operated, and maintained in accordance with the manufacturer’s instructions and applicable safety requirements. Please ensure products are suitable for their intended use before installation.

18. Delivery Refunds

Where applicable, delivery charges may be refunded in accordance with our refund and returns policy. Refund eligibility may depend on the reason for the return, cancellation, or delivery issue.

19. Cancellation Form

Customers may use our cancellation form to request cancellation of an order. Cancellation requests will be reviewed in accordance with our cancellation policy and the applicable consumer rights.

20. Consumer Rights Notice

Nothing in these Terms & Conditions is intended to limit or exclude any statutory consumer rights that cannot legally be excluded. Your rights may vary depending on applicable consumer protection laws.
